1. Who We Are
Dwella is a home maintenance reminder service operated by Impact Marketing Group, LLC, a Utah limited liability company located at 717 North 1550 West, Kaysville, UT 84037 ("Company," "we," "us," or "our").
Dwella provides a platform that allows licensed real estate agents ("Agents") to send automated, personalized home maintenance text message reminders to their former clients ("Homeowners"). This Privacy Policy explains how we collect, use, disclose, and protect information from both Agents and Homeowners who interact with our platform.

2. Information We Collect
From Agents (account holders)
- Account information: First name, last name, email address, phone number, brokerage/company name, and password (stored as a one-way hash — we never see your plain-text password)
- Billing information: Subscription plan selection. Payment processing is handled by third-party providers; we do not store full credit card numbers.
- Usage data: Log data, dashboard activity, homeowner counts, reminder delivery statistics
From Homeowners (clients of Agents)
- Contact information: First name, last name, cell phone number, email address (optional), home address (optional)
- Home profile data: State, climate zone, year built, lawn/garden features, cooling system type, water heater/softener, roof age, pool — used solely to generate personalized maintenance reminders
- SMS consent: Date and timestamp of consent provided on the intake form
- Communication data: Delivery status of text messages sent, opt-out/STOP requests, and any inbound replies
Automatically collected data
- IP addresses, browser type, device type, pages visited, and timestamps when you access our website or intake form
3. How We Use Your Information
- To create and manage Agent accounts and authenticate logins
- To send automated home maintenance reminder text messages to Homeowners on behalf of their Agent
- To generate personalized maintenance schedules based on Homeowner home profile data
- To provide Agents with dashboard analytics (delivery rates, homeowner status, reminder history)
- To process subscription billing and enforce plan limits
- To respond to support requests and communications
- To comply with legal obligations, including TCPA opt-out processing
- To improve and maintain the Dwella platform
We do not sell, rent, or trade personal information to third parties for their own marketing purposes.
4. SMS Messaging & TCPA Compliance
By using Dwella, Agents represent and warrant that they have a legitimate prior business relationship with each Homeowner they add to the platform, and that they will not use Dwella to contact individuals who have not consented to receive text messages.
Standard message and data rates may apply to Homeowners receiving text messages. Message frequency varies based on each Homeowner's home profile and maintenance schedule.
To opt out of all messages, Homeowners may reply STOP to any text message, or click the unsubscribe link included in messages. For help, reply HELP.
5. How We Share Your Information
We share information only with the following categories of service providers, who are contractually required to protect your data:
Infrastructure & Hosting
- Vercel, Inc. — web hosting and serverless infrastructure
- Supabase, Inc. — cloud database storage (PostgreSQL)
Communications
- Twilio, Inc. — SMS delivery platform. Twilio processes phone numbers and message content in order to deliver text messages. Twilio's privacy policy is available at twilio.com/legal/privacy.
Other disclosures
- When required by law, court order, or legal process
- To protect the rights, property, or safety of Impact Marketing Group, LLC, our users, or the public
- In connection with a merger, acquisition, or sale of all or a portion of our assets (with notice to users)
6. Data Retention
Agent account data is retained for the duration of the active subscription and for up to 90 days after account closure, after which it is deleted from our systems.
Homeowner data is retained as long as the associated Agent account is active. Agents may delete individual Homeowner records at any time from the dashboard. Upon Agent account deletion, all associated Homeowner data is deleted.
SMS delivery logs are retained for up to 12 months for compliance and analytics purposes.
Opt-out records (STOP requests) are retained indefinitely to prevent inadvertent re-contact.
7. California Residents — CCPA Rights
If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA):
- Right to Know: Request disclosure of the categories and specific pieces of personal information we have collected about you
- Right to Delete: Request deletion of personal information we have collected, subject to certain exceptions
- Right to Opt-Out: We do not sell personal information, so there is no opt-out needed for data sales
- Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights
To submit a CCPA request, email us at privacy@dwellarealty.com with "CCPA Request" in the subject line. We will respond within 45 days.
8. Data Security
We use industry-standard security measures including:
- TLS/HTTPS encryption for all data in transit
- Passwords stored using bcrypt one-way hashing (never stored in plain text)
- Token-based session authentication with expiration
- Database access restricted to authenticated API calls only
No method of transmission over the internet is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. In the event of a data breach that affects your rights, we will notify affected users as required by applicable law.
9. Children's Privacy
Dwella is intended for use by licensed real estate professionals and adult homeowners. We do not knowingly collect personal information from individuals under 18 years of age. If we become aware that a minor has provided us with personal information, we will delete it promptly.
10. Changes to This Policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the "Effective Date" at the top of this page and, where appropriate, notify Agent account holders by email. Your continued use of Dwella after any changes constitutes acceptance of the revised policy.
